From what you have indicated (assuming the exhaust is legal) then you are still guilty of modified emissions (intake and chipped ECU). That would mean that the 40001 infraction will stick - the car was operated illegally.
If the exhaust is in fact less than 95 db, then you should be able to get that part of the ticket dismissed, but you are probably stuck with the other two. If you go to court, you should be able to get the exhaust part thrown out.
You will also probably have to return the emission system back to stock - the original intake and un-chip the ECU...
