I would believe this is covered by warranty. If the car is stock and used under normal conditions, the part shouldn't fail, and if it does, should be covered by the warranty.

If the car is used significantly on the track, then consideration should be given to upgrading to the toe-link brace to alleviate the possibility of a catastrophic toe-link failure. If the car has modified suspension and/or stickier than stock tires, then it may not be covered by the warranty.
