IMO, you need to post another "Need a repair shop" thread. Whether by negligence or honest error, they should lose they chance for your business. And this repair is 'business' for them; even though it would be out-of-pocket, they'd be saving a lot by keeping their insurer out of it. They certainly must not be trusted to determine repairability at this point.
Stuart's carries insurance for the same reason we do. Their carrier can pay your new repair shop, and yes, your diminished value claim.

Pfft frame damage or not, mine was declared totaled from just the clam+crash structure. You have to keep in mind diminished value and other crap, it's really all a pain
I would push to have the car totaled, just get another one. I ended up actually saving $ this way (used ones are cheap now). Besides, you don't really want one that's been compromised now, do you? You shouldn't end up with the short end of the stick, that just isn't right. Good luck, oh and make sure your insurance co. includes the value of any options the car had on it, mine neglected to add them at first and I got it bumped up another ~3k |

very doubtful that the frame is damaged... more of the clam would be damaged at the sides if it was or one of the wheels would have to hit. This looks like its head on..... Either way the crash structure is done so thats going to need to be replaced and thats going to be expensive.
The shop might want to do the work on thier dime which wouldnt cost them as much even doing it the proper way. I would say let the shop fix the car and tell them that you want it fixed perfectly. Accidents do happen and while it totally sucks that you were unlucky enough to be the one it happened to, they do occur and it doesnt mean that the shop is necessarily bad; its all about how they resolve the problem which will determine whether they are as good as everyone says. Incidentally my guess is not that anyone was out hot-dogging in the car but rather they guy was styling along and checking out girls looking at the car rather than looking in front like they should have been... |

What the heck are they doing driving it to an alignment shop. Any transportation from one shop to another should be done on a flat bed. 100% chance no one will be joy riding anything. Its stories like this that make me do my own repairs unless I dont have the tooling to do so. IF they are really a reputable place they will do everything they can to get your car back to you in excellent condition. Should have no problem getting you a rental. At this point they should be bending over backwards for you.

A lot of us know Stuart and he has a significant reputation to uphold. PM me if you get stuck, but he should offer and is legally obligated to at least cover all repairs, pay for diminished value, and loss of use. For the latter, make it clear you want a nice, comparable sports car, not a rental Camry. I'd suggest that he get you into a replacement car right away and it is his problem to repair and sell your (his at that point) vehicle, although legally all you can do is get $ for your damages.
If he gives you any grief at all, let me know. As for alignment, odd that was not done on-site. I string-align my own car and it is super easy on the Elise. I think I saw your car at RUF, now that I think about it, and in passing they said it was in for control arm and alignment |

kverges, thank you very much. Yes, RUF found additional control arm damage when they were doing alignment and fixed that as well. I have no doubt Stuart will do the right thing. Ill will have my own mechanic inspect the car though, just to be sure everything is replaced with new parts if its damaged. If theres frame/structure damage, I'm not going to take the car back. I already mentioned loss of use to him, and he said hes never heard of it

Let us know what their insurance company says. (And make sure it's on their insurance, not yours).
I'm thinking they might go with totaled, which would be your best option. =/

If you have your insurance claim this it may show up on your CARFAX when you list it for sale which = loss in value.

sorry to hear about your loss.
hope it works out for you. my opinion is to see what Stuart's offers you first... if you are not happy, maybe try your insurance company - since you already reported it to your insurance company, would it hurt to ask them for more advice? if you are still not happy, i have found that a $500 letter from a lawyer tends to make people and companies listen more carefully to what you have to say although I think lawsuits themselves are not very effective good luck!!! |

something similar to this happened at a local dealership here in greensboro. except they took the car to the alignment shop and the alignment shop wrecked it. the car was totaled. the alignment shop had to pay for a new murcielago.
