Bank of America is robbing me.
Ultimately this comes down to what you can prove, and I think I am ****ed. But read on if you like.
And I might as well add now that I will be writing with a few more expletives than usual. For anybody who doesn't use BoA, BoA has ATM's that accept cash/checks and give immediate credit for them. It's great. It allows you to use your Visa Check card immediately with any funds you just deposited. And it has never not worked for me before, and I have never had any reason to not have faith in the technology, or BoA...(get ready for the most powerful two words of any introduction like this) until now. Anyway, several weeks ago, I tried to deposit $800 cash, 3 $100 and 10 $50. The machine gave credit for $300 and made a note that it could not count the rest. Some error. I have a receipt showing this. There was a prompt for the value of the remainder that was not credited. A prompt that I have never seen before. Somewhere inside this machine, there is $500 extra dollars that I am sure will be found when the next person that makes ATM rounds opens it up and compares deposits to receipts. Even up to this point I have faith that everything is going to be rectified because I know what cash I gave to BoA via their machine and service that they offer. I talked to several people on the phone, they all assure me the same nonsense. I reached BoA Fraud dept for ATM transactions. Yep, a whole department for **** like this. And they say that it will take 45 days(what kind of backlog is there for it to take 45 days?) to research this dispute, and in the meanwhile they give me $500 on the good faith that I am not lying. Great, so now all I need to do is wait on the formality of their admission that they ****ed up and carry on with life, right? Apparently, No. Today I get the letter saying that they have done nothing wrong, and that all monies are as they should be and that I have deceived them. They are taking back the $500 and assessing any fees they deem are appropiate based on what has happened. ****. Just ****. I have kept the few little receipts regarding this problem. Little tidbits of information that I could not possibly have unless what I say happened actually did happen, and they are screwing me. I should sue these ****ers, but for such a small amount, it will be need to a class action suit. What a pain in the ass. But they should pay for this. As my pal Leonard says in Blood Diamond, "I like to get kissed before I get ****ed". And I am getting ****ed. So that's that. Advice. Help? ![]() ![]()

Sorry to hear about your situation man. Looks like it does come down to who can prove what at this point. When the machine stole your $500 did you go into the bank and complain to the manager???
I have to agree with Patricko. My bank manager asks me all the time if i want to use the ATM to deposit money and i always say no because of situations like this. I dont mind spending the extra few minutes of standing around to go and deposit with a teller, i dont need the headache and the long process of fighting with my bank.

I was an internal auditor for a bank about 25 years ago, and as part of my audits of the branches I would audit the ATM. The branch ATM you used will have hardcopies of documentation of all transactions, noting discrepancies as they occur in real time. Also, as someone already said the reconciliation of the ATM will note that extra $500. The ATM audit trail along with your receipts should be more than enough proof that the money belongs to you.

I had something similar, I attempted to withdraw ~$400 and nothing came out. My account was deducted though. In my case the bank was open so I just walked in and complained. They indicated that it would fix overnight when the atm was verified.
It wasn't. So I complained again, this time online and they wrote back to me indicating that I should "come down to the bank and talk to someone". I responded that I had already talked to someone, and asked if they would fix it or not, and was it their position that I was lying? The money was shortly put back in my account. The problem here is, most banks suck, and really could care less about you. Not just BoA.

Pita. Progress. Finally have gotten high up enough to talk to somebody who doesn't just apologize and thank me for using BoA. Still nothing resolved. But I have a direct number to this person, and am told that they aren't going to **** me yet until they do everything again based on the new information that I'm not going to bend over and take it.

BofA stopped using depost envelopes a little while back, so i suspect that this is what the issue is concerning. I think it is a great idea for checks that way you just put it in and you are done, but i got into the habit of writing out a deposit slip with certain amounts on it such as check totals, cash totals including the amount of a bill and that total amount, and then i finalized it all with the final part of the total.
Sounds a little scatterbrained, but classes are driving me crazy. |

I know this won't help you now, but would it help if one wrote down the serial numbers of the bills before they are inserted into the ATM?
Then if there is a discrepancy, they can open the machine and check the numbers against the ones you wrote down. Unless you are Criss Angel, how would they be able to tell you that you're full of ****? ![]()

I hate to say, but unless you can complain long and loud enough I think you are hosed. Do the complaining in person to the manager where your account is based.

Not that this really helps you but... my bank is in Texas (USAA) and therefore I never put actual cash into my bank account (only take it out). Better just to keep the cash around and gradually use it up (instead of using your debit or credit card).
