I think that they would be ruled legal at this point, but I think that's different from the clarity of their purpose. They're pretty obviously an aerodynamic item, with air flowing over both sides of them, making them a winged surface by the definitions in the rules. Now, arguably, by the definition in the rulebook, your whole car is a wing, but it's just not nearly as clear cut as I would like. Saying that it's open because it's attached to the clam is like exploring the grey area about what forms a canard. If I make a small bump on the sides of my clam, is that a canard? When does it become a canard? etc. etc.
