:huh: How does one get a speeding ticket for 50 mph in a 55 mph zone?

The road up to Mount Pinos is VERY wide road, improved with asphalt, but there is no centerline. Nice sweeping curves that can easily handle 55 mph.
The last speed limit sign on the SAME ROAD says 55 mph!

When we drove up to the mountain with 10 Exiges/Elises last weekend, the CHP did a fast U-turn, lit up his lights and stopped ONE of the cars (middle of the group). We all stopped, and we all thought we all would get tickets. We were not speeding, we thought it was the infamous "no front plate" round up. My speedometer read 50 mph when the CHP took his U-turn.

The officer gives the one driver in our group a speeding ticket going 50 in a 30 zone. Then he gave him a lecture that there are bicycles, people, babies, dogs, squirrels, caterpillers, beetles and amoebas on the road, so he better slow down! We are terrorizing innocent and peaceloving citizens with our loud and obtrusive sports cars! WE (us) are BAD PEOPLE! :no:

Where was the 30 mph speed limit sign? :huh:

The next day, two of us drove the same road, looking for a 30mph speed limit sign. There were none. Just the 55 mph at the base of the mountain. I thought the LAST speed limit sign applies on the same road.

Maybe you can figure this one out. I cannot.:shrug: :popcorn:

Doesn't the ticket say something about how the speed limit is determined in the area, i.e. either posted sign or traffic reg? If his determination is wrong, the ticket is invalid.

Unless the road changes layout considerably, or enters a resi/com zone then the last sign should apply I would think.

I was looking on the way down hill and could not see any 35 mph speed limit signs. But I guess since we were entering a park, maybe another rule may apply, not sure about that. But 35 mph would be BS, it would be way too slow and boring.

Could be one of those places that has an implied speed limit even if there are no signs posted. It's like a general law that states "in area x speed limit is x mph". Ignorance is no excuse from the law (I've heard this a few times before).

That's weird he'd only give one driver a ticket. They like to stand up road blocks, engage the SWAT team, and practically call in an airstrike anytime we have a group of sports cars driving in a group here.

I was in the group as well and I'm not clear how the 50mph was established - my V1 did not go on and the detector of the guy driving behind the one being pulled over did not go off either. :shrug: Plus I was driving extra careful because:

1) I had never driven on that road
2) there was some gravel and debris on the orad
3) I got a ticket last week (unjustly I think) and now I drive mellow!

So - I guess because he was in low gear and the 2nd cam is just not as silent as the first? Meh.....

Two blanket laws could have been in effect in that area. I didnt see it but you tell me if one of these apply.

Business or residence districts

The speed limit is 25 mph, unless otherwise posted.

Blind intersections

The speed limit for a blind intersection is 15 mph. An intersection is considered “blind” if there are no stop signs at any corner and you cannot see for 100 feet in either direction during the last 100 feet before crossing. Trees, bushes, buildings, or parked cars at intersections can block your view to the side. If your view is blocked, edge forward slowly until you can see.

It was not business or residence and there were no intersections. This is a picture of the road. The car that was pulled over was the fourth car so he was clearly in the middle of the group. It is maybe a couple of miles up a hill to a parking lot.

Take some pictures of the road and where the speed limit signs are and submit your plea/evidence thru Trial By Declaration. Hal, i'm surprised you didn't get ticketed, you look like a "street racer" type rotfl j/k

I was thinking the same thing - the red one! - I knew it before I saw the pic.

It it were me I would make a vid starting from the 55mph posted sign driving up to where you were pulled over as conclusive proof of no sign. If you don't do that, expect the cop to lie outright and say there was a 30mph sign. Don't offer up the video up front. Let Johnny lie first, then correct his lie. He speaks first in court, let him bury himself.

Have a Garmin or TomTom GPS in the corner of the shot to establish proof of location.

I hope he fights it... update us with the outcome

here in hawaii there is no such thing as an implied speed limit... if the limit isnt clearly posted within a certain distance(every couple miles or so) most tickets will get thrown out(if you are doing 110 you are still boned)

I missed all the fun. I arrived late to the Flying J and had to make my way up to Mt. Pinos by myself. Thank God--Cops love RED CARS.

A few miles from the top I passed a bunch of Out Law Lotus' pulled over by the CHP. I kept going because if they were going to jail--count me out. I said to by wife that those cars looked liked the same ones we saw at the Outlaw Lotus Gang meeting a few weeks back near the county line.

They want to form a club or something. I guess they need a few of us middle age guys so they look innocent. What are they up to? Alcohol (E-85), Drugs(Viagra), or just plain speed.

Great trip Hal. Too bad someone's day had to ruined. Next time put the Radar Detectors up front and we can all rear end the car in front of us as they slam on their brakes. I know, this guy was just using visuals and picking on the fastest looking car. Of course the supercharger and screaming exhaust might have been a dead give away.

That cop did a Dukes of Hazzard U-turn right in front of us, then got behind me and turned on his lights... I had already slowed down to about 15 mph when I passed the cop's dust cloud. Then he jumps out to the left lane and guns it, passing me and nearly colliding with an on coming car (jerk cuts me off too :mad:) Too bad there were other Lotus behind me or I would have released my James Bond bucket 'O nails on him :D

Seriously, I hope that everything will be fine and the ticket will be dismissed. Or at least get extended so traffic school will be an option.
